I don't like Alan Dershowtz. I started to dislike him during the OJ criminal case. Not because he was defending OJ. Afterall, that was his job and the U.S. Constitution says that criminal defendants have the right to counsel. I started to dislike him because his ultra high level of self-promotion did not, in my opinion, match his record of achievement. I really started disliking this guy when he referred to himself as the OJ Criminal Defense Team's, "constitutional strategist." I am from Ohio and in Ohio we have a name for "constitutional strategists." We call them criminal defense lawyers. Let's face it. Dershowtz, what a windbag!


Why is what I just said important? Because too many people in this country think people "did it," or "did not do it," in both civil, criminal and administrative law cases based on the accused's politics, backgrounds, the color of their skin, their religious views, their educations and all sorts of other irrelevant stuff. But the problem is that the one and only thing -THE ONE & ONLY THING - that should matter is the evidence. Somewhere , sometime too many people forgot about that. Rule #1 in contested legal cases: Evidence talks and everything else should walk. Rule #2 is that people should listen carefully to the evidence and then evaluate it using good judgment.


That is one of the lessons Dershowtz makes in this insightful book. He does not say sexaul harrassment is not real, because it is. He does not say that sexual assualt is not real, because it is. He does not say rape is not real, because it is. He does not say that it is okay to sexually harass, assualt or rape anybody, because it is not okay. It is not even close to okay. It is always 100% wrong. (I hope I have made that point reasonably clear.)


What Dershowtz says is that just because somebody says, or claims or alleges some terrible sexual event happened, and that X (fill in the blank) did it, does not make it so. Only evidence can make it so. (Remember Rule #1, from above.)


So I recommend this book. Before you call me a Commie, or whatever it is they are calling people like me these days, please know that I am a lawyer who has successfully represented women in sexual harrassment cases, and I have successfully represented men in sexual assulat cases and in rape cases. Many years ago I spent about 5 or 10 minutes working as an Intern in the Office of Rep. Bella S. Abzug of New York, who, back in "olden times" was big in The Women's Movement. And back then, it was not always easy to be part of The Women's Movement. (Frankly, my feelings about Bella are sort of similar to my feelings about Professor Dershwotz. Sorry, Bella. You were very smart, very hard working and totally dedicated to your beliefs, but you should have mixed some crazy glue in with your toothpaste. You would have gone a lot farther in politics if you had.)


Which is all just another way of saying: Show me the evidence. Evidence talks and everything else walks. If you don't believe me, read this book.

The late radio broadcaster, Paul Harvey used to have a show entitled "The Rest of the Story". This book easily falls into that category.


I'd heard news reports of the accusations against Prof. Dershowitz related to pedophile Jeffrey Epstein. Those accusations were carried far & wide by main stream media and the flames were fanned even further by the #MeToo movement. But I've also seen Prof. Dershowitz being interviewed on television where he adamantly denied the charges. His denials have always been very forceful and seemed genuinely sincere. Given the distinct conflict between the charges and denials, my curiosity led me to buy & read his book.


I found Guilt by Accusation to be a very compelling & convincing account of the "rest of the story" that never seemed to make it into the main stream media. And that fact makes the book horrifying. Why horrifying?


First, generally speaking, Prof. Dershowitz's case is a clear example of a disturbing trend in the country where our U.S. Constitution is being turned upside down. Where instead of accusers having to PROVE beyond a reasonable doubt that the accused is guilty; suddenly and wrongly, the accused is ASSUMED to be guilty until THEY prove their own innocence.


Specifically the book is horrifying because while Prof. Dershowitz was very publicly accused...the FACT that he has been CLEARED OF THOSE CHARGES IN A COURT OF LAW, has never received wide publication. His book very clearly lays out how he was basically framed by unsavory characters who admittedly lied when making the charges. And how in spite of being cleared, the media in many cases has ignored that fact often even ignoring evidence of his innocence provided to them. Whether or not one buys into the concept of rampant "fake news", this book lays out very clear examples of fake news being intentionally disseminated in disturbing, if not criminal ways. And because of the misinformation campaign an innocent man has continued to be harassed by false charges.


The scary thing about this book is if this kind of miscarriage of justice can happen to someone of wealth and name recognition...someone with the financial & legal resources to fight the charges...one has to wonder as to the devastating impact it would have were the same false charges leveled against an innocent John or Jane Doe. The person would be ruined.


Although the book contains a lot of legal jargon, by necessity, it is easy to read and organized in a way to make clear what happened and why. All Prof. Dershowitz asks of his readers is to give him the same assumption of innocence afforded all of us in the Constitution when they start to read. If readers approach the book with that open mindset, the evidence of his innocence is thoroughly convincing.

The interesting thing to come out of this book is not that innocent people can be maligned, which most of us knew already, but how the process of doing this for gain has been industrialised by the US claims industry. It must provide some comfort to Dershowitz's family that their true friends and fair minded members of the public alike can read his side of the story which is completely absent from Netflix, the press and the storm of pedo GIFS bombarding his Twitter account.

If you want to be informed, you must be open to hearing both sides. Dershowitz provides this. It's unfortunate that so many see this as "anti-#MeToo" because it's absolutely not. Dershowitz has defended some of the most despicable creatures imaginable. He knows the rules of the law "game" very well and is sought out because he's good at it. Playing this game has served him well over his career and now he finds himself on the "victim" side of things. There are people who are not playing "fair" and he's in the struggle of his life.
I'm reminded of the saying, "Lie down with dogs and you'll end up with fleas." Well, Dershowitz has lain with too many dogs. The itch is on!
Despise him if you like, but he makes a compelling argument for the rule of law. Fail to defend it at our peril.

This book and the SCOTUS hearing and interviews about Judge (nowJustice) Kavanaugh drive home several points. There are women and lawyers who are willing to prostitute their characters and reputation for money and notoriety. Second, there are lawyers who are willing to read havoc on the First Amendment by using the current court system to deny Vicki a of worthless allegations to adequately protect the,selves from FALSE accusations. Third, the “Me To” movement and the majority of their accusations are based on the fact that women MUST always be believed even when he allegations s are proved to be based on lies and false statements. The author and others like Judge Kavanaugh had their reputations dragged through the dirt via false accusations and perjured statements and false and manufactured evidence. Unfortunately, the accusations were given to the partisan media to spin the accusers falsehood into making those accused to be guilty in the court of public opinion and not in the halls of justice.
The book highlights the fact that it is shameful that men, regardless of their social status or positions, can be accused of wrong doing (sexual impropriety) without any proof, forensic evidence or corroborated statements of witnesses. The “Me To” movement erupted into the public eye with cases on two famous men who had truly assaulted women; but, the jealous ness of the leaders of the movement and their followers took the true intention of the movement and bastardized it into allowing women to make unfounded allegations concerning men who are normally high profile and rich white men. The author showed press plays right into the accusers hands and through their medium attempted to destroy him financially and ruin his reputation via the court of public opinion. The book said with out hesitation that founding fathers did not intend common everyday people to be harassed and defamed by false accusations that fall under the auspicious of the 1st Amendment.
The author did a excellent job in stating his case and how the accused and her attorneys and members of the press got away with destroying people and allowing them to subvert the 1st Amendment. A great book and it should scare the pants off every man who lives within he boarders of our great country.

This is an account that claims to do 2 things, first, Mr. Dershowitz seeks to defend himself against allegations made against him in the court of public opinion. Second, it purports to present a case of problems in our court system and culture, focusing on the #MeToo movement.


Dershowitz does a good job of the first goal, if the evidence is what he says it is, believing the allegations against Mr Dershowitz would be irrational. He makes a weaker case in the second regard, largely because he focuses solely on his own case. There are no balancing discussions related to the innocence project, no comment on studies about false police reports of sexual assault, nor parallels to the dangers he espouses to reveal, outside of overly brief references to McCarthyismand some criminal trials involving daycare during the Satanic Panic (the later being extremely germane to #MeToo). Outside of cases involving David Boies, there are few parallel cases. As he is discussing journalistic ethics as well as the legal system, issues related to due process concerns on University campuses would be germane.


Because he really only meets one of his two objectives, I could not give this more than 3 stars.

Of all the people to pick on, you wouldn't think anyone would go after Alan Dershowitz! The only problem I had with the book is that he doesn't take this issue on as comprehensively as I would have expected from him. I am a woman and a lawyer and some of the current abuse movements have seriously concerned me as a welcome mat for a lot of miscarriage of justice cases, especially trial by media and online. As a lawyer who is most famed for challenging this type of tendency in society and in Court, I had every hope that Professor Dershowitz would have addressed the bigger issue but he spends the most part making his own case, which he does very well, over and over, rather than analysing the social phenomenon and assumptions that create the perfect conditions for aborting justice. That is what he is known for and I hope in the next edition he examines this problem more in depth. If anyone dares, it would be him. We need minds like his to keep the law on its toes!

In 113 pages, this book describes how it is that the author, Alan Dershowitz, could be accused of having trafficked sex with Virginia Giuffre in spite of the knowledge of both the accuser Giuffre and her lawyers that the accusations were false.


The tactic is mostly unknown to non-lawyers. It is called litigation privilege. When filing a suit, a plaintiff can make a charge, say of inappropriate sex, to a third party, and is protected from defamation lawsuits by this privilege. On the other hand, the accused may be sued in court if he denies the false claims.


This asymmetry in rights can make it virtually impossible for the accused to defend himself with the simple statement, "I'm innocent," without risk of being sued for defamation. And defense against such a suit entails considerable cost, which may prevent a meaningful defense.


Dershowitz explains how this is justified by the legal system, but points out that it is subject to abuse in the age of Me Too, in which woman accusers are often believed without needing to present evidence.


Thus Virginia Giuffre, and two other accusers of Jeffrey Epstein, seem to have fabricated stories of encounters with Dershowit. For example, Virginia Giuffre has claimed that Dershowitz had sex with her at various specific locations on seven occasions, and Dershowitz claims that he has records showing he was not in the locations in all but one case. In that case, both were present in New York City at a given point in time, but that is a huge area and there is no evidence of their ever meeting.


Yet the media have portrayed Alan Dershowitz as a pedophile, and have prevented him from appearing on various network television programs and canceled invitations for him to speak.


Dershowitz also suggest that the lawyers for the accusers were trying to shake down Leslie Wexner for a big payoff to keep silent about what they knew.


In today's atmosphere an allegation of sexual impropriety can destroy a career. Along with Dershowitz, Giuffre has accused Prince Andrew of England of having sex with her.


A troubling dynamic then takes over. Scandals of the royal family sell lots of newspapers. And newspapers want high circulation. So they fail to fact check stories to satisfy readers who want salacious stories.


Or maybe they think that an accusation that is shielded by litigation privilege can be accepted as proven fact, even if the lawyers who made the accusation have no intention of pursuing it in court.


This seems to have been the case with writer Julie Brown of the Miami Herald, who wrote many of the stories about Jeffrey Epstein's "sex slaves" that were then copied elsewhere.


Julie Brown was even put forward for a Pulitzer Prize.


This might be part of a larger problem which accepts claims of inappropriate sex against famous men as accepted fact, with inadequate fact checking.


The charges in this book are explosive. At the very least they should cause people to question the wisdom of some of the assumptions made by the Me Too movement, such as "women can never lie."

Alan Dershowitz is a famous defense attorney. He taught from a young age at Harvard, where
he had generations of students such as the brilliant Sen. Ted Cruz. He has had many famous
clients, such as O.J. Simpson, and above all he just likes to make everybody mad. I remember
his 2000 debate with Ambassador Alan Keyes, who actually agrees with him on Israel. Their
debate was on religion and public life, but Dershowitz was not arguing from an atheist perspective.
He said, on some days I believe (raised as an Orthodox Jew), some days I disbelieve, and some
days I am skeptical. Now he likes to troll liberals with his defenses of President Donald Trump.
He didn't vote for Donald, he just likes to defend tough cases.


This book is his defense against accusations of having sex with an underage girl. Dershowitz is
now in his 80s and needs to clear his name, if not in court than through writing and showing
the evidense. The Jeffrey Epstein case also involves Prince Andrew, as well as Bill Clinton,
Donald Trump, George Mitchell and many other famous men. Dershowitz says he never even
met the accuser Virginia Roberts Giuffre.


The Dershowitz defense is the occasion for a broader discussion of the Me Too movement that
began with the Harvey Weinstein case in Hollywood. It has done a lot of good according to Alan,
but also has led to some problems. Our rule of law requires that the defendant is innocent until
proven guilty. There is due process and the presumption of innocence. Dershowitz says, I don't
know if my clients were guilty or innocent. I assume that most of them were guilty. But I know
that I am innocent. He even says that "almost every criminal in the world has been able to
contact me", in response to someone who contacted him through his publisher.


The day of the Kavanaugh hearings, I was arguing with a friend and the argument was made
that false accusations of sexual misconduct hardly ever happen. When that approach is taken
to believing the women, guilt rather than innocence becomes the presumption, and that
will create problems for the law.

Lawyers do a necessary and often unsavory service in our justice system. It is akin to mob rule, were ends justify the means, justice cast aside for predetermined sins. It seems the perfect storm has struck Mr. Dershowitz. Guilt by association and legal duty to a high profile pedophile, the rise of the justice-less Me Too movement, the political savagery against Trump and anyone who even remotely agrees with or defends him, and one last factor he never mentions, Anti-Semitism. While he is well known for his support of Israel, I personally believe at least some of the motivation against him is his faith along with his success. Besides loads of documented evidence of his innocence, he has offered to submit to a federal investigation, no restrictions or restraints, to prove his innocence. If his accusers will do the same. No guilty person would do that. He has been demonized and slandered but at least he can afford to attempt to clear his name. You and I probably will not and this can happen to anyone. Alan Dershowitz is innocent and this witch trial injustice has to be stopped. The Supreme Court nominee Justice Cavanaugh‘s confirmation hearings were a travesty, more acute and in a smaller timeframe, but equally as despicable as Mr. Dershowitz’s experience. Vote, it’s obvious which political party supports it and which will stop it.

The first time I heard of Alan Dershowitz was when he was defending O.J. Simpson. Since that time, I'd heard him referred to occasionally as a powerful advocate for our constitution and as a "distinguished Harvard law Professor." The first time I saw him on Fox making a case against impeaching President Trump, I was stunned and wondered if there was some hidden agenda behind his stance. How could this openly liberal person be advocating caution about getting rid of a president whose political philosophy was the polar opposite of his?
Since that time, my curiosity has led me to research and learn all I could about this amazing man. I have read many of his books including those on the dangers of impeaching and/or removing a president on trivial charges.
However, although I had learned something of the accusations made against him by Jeffrey Epstein's "girls," I never realized the magnitude nor the extent of the unsubstantiated charges. And what is more revealing and downright chilling is the injustice in our so-called "Justice System" Where the rights of the accused are restricted by laws that go against every grain of common sense, decency and fairness.
Crooked lawyers seeking fame and financial gain at all costs, and who are willing to manipulate self-serving clients, along with a media that has largely become obsessed with sensationalist and "gotcha" journalism as opposed to the truth are at the basis of this outrageous trend.
Guilt By Association is like a survival course in the Kafkaesque #METOO movement where the accuser is always to be believed and the accused remains guilty even after proving his innocence.

I don`t reccommend many books to the extent that I reccommend this one. The issues discussed in this book by Mr. Dershowitz should send shivers down everyone`s back. Our society has already reached a dangerous point of rationalizing "if it sounds right, it must be true." There is hardly a subject discussed that doesn't fit into this mold today. Evidence has little value to those that take that position.


As is pointed out in the text, the current legal system is in collusion with this process. What may have been originally thought to have been a proper and consistant process to protect the rights of the accussor has grown into a catch-22 with the collusion of an ultra-liberial media and unscrupulous lawyers. To hope that this may be corrected requires a lot of hope indeed.


To repeat a passage by Eric Hoffer as stated in the book, "Every great cause begins as a movement, becomes a business, and eventually degenerates into a racket." The #MeToo organization could be said to have started down that path, but it may have gone too quickly through the movement stage, skipped the business stage, and is now plunging headlong on the precipice of degenerating into only a racket. The idea that "all men lie and all women don't lie" is the first jump over the edge.

This tactic has no place in a free society yet Dershowitz is a lifelong supporter of politicians and the political theories that produced the very laws that almost destroyed his life. It's a great, quick, frightening read but by the end I couldn't help but get angry at the fact that as brilliant as this man is he still doesn't understand that he's the victim of his own ideology and voting record. I didn’t know that in many states a citizen can falsely accuse you of rape or other crimes while remaining protected from your defamation suit by making the accusation behind the firewall of a court filing in an otherwise unrelated case. I am outraged while reading Alan Dershowitz’s horrifying experience of being a victim of such a legally protected smear campaign. I also consider the mainstream media’s reckless disregard of this outrage—while casually smearing Dershowitz's reputation by repeating demonstrably false accusations of his accuser—to be absolutely despicable. On a political level it appears to me that around 2016/2017 when Dershowitz revised his earlier book draft from “the case against impeaching Hillary Clinton” to “… against impeaching Donald Trump” he experienced not just a loss of ultra-liberal friends but something tantamount to loss of citizenship. Where in the Hell is the ACLU? This is a unique and courageous book. I admire Dershowitz for standing up to protect his legacy and reputation. I hope our grandchildren will be able to appreciate him for pushing back against guilt by accusation without evidence, the dangerous standard of both the Christian Inquisition 500 years ago and of today’s #MeToo movement.

what has been written. My point is that when fiction meets fact it is quite interesting.


Mr. Dershowitz has had a long and distinguished legal and academic career. I understand why he is trying
to get the facts out. If it were not him accused but another they may have reached out to him to defend them.
I see this as the only way he could present the facts. Others in law enforcement do not seem to want to
take this case on.


I did not see it as self serving but a presentation of facts backed up by documentation.


If true, the law firms and journalists mentioned, the facts should be brought out in a court of law and appropriately judged.

In 66 years among my fellow humans, I have learned to assume we are, at best, inaccurate even when we try to be accurate. But in too many cases, we tend to only embrace information that supports our own opinions.


But worse, people with something to gain are more likely to lie to themselves and others. This includes competitors of all kinds, politicians, reporters and politicians.


So I have been accused of being too objective, which I hardly see as an insult.


For this reason I had not understood how far Mr Dershowitz's situation had gone and how badly it had been handled by the media.


I commend him for standing up to this onslaught. This book is a lucid defense and a clearly stated education for all of us.


Certainly, Mr Dershowitz is a reluctant champion, but I cannot think of a more qualified one.

The book is timely in the age of MeToo. Let me tell you what scares the crap out of the cultural environment of 2020. There are some things for which you simply do not want to be accused: child molestation for example. You simply cannot escape the stigma no.matter your innocence.


Fortunately, Dershowitz knew what to do; had the skills, knowledge, and resources. In his defense he wrote op-eds for national media and was heard. He kept meticulous records.


The ordinary person does not. Get up to speed with today's dangerous cultural chaos and hopefully learn from an innocent man's battle with scammers motivated by greed.

Professor Dershowitz makes a chilling case that if this can happen to him, it can happen to anyone.


He and his family should never have had to go through the ordeal they've been forced to endure.


Although the Professor is a public figure and one might think this type of thing "goes with the territory", my reaction was far from that sentiment. The feelings I had toward the way this Man has been treated ranged from sympathy to soul wrenching anger and a real concern for where the behavior of the attorneys and media he outlines in the book leads us.


Finally, in spite of this book being a quick read, it is long on substance. While it is likely a necessary and important defense of Mr. Dershowitz's now obvious innocence, it's also a vital contribution to informing anyone willing to face reality about the methods being used by some to gain advantage at any cost, monetary or otherwise.

This book highlights another reason our legal system needs to be completely overhauled. As a nation, we've lost sight of the concept of seeking justice, and made the legal system a game where the winner is not truth or justice, but the lawyer who can play the game the best.


There was some fascinating information in this book. Sadly, the presentation is quite repetitive and tedious. It's a slog to read, but the information is important.

Hold these false accusers accountable! Prosecute the real perpetrators. By the way, what does happen to those who falsely accuse, ruin people’s lives, family and the ability to find work. What happens to them? I’d like an answer to that.

It’s time for the Supreme Court to get proactive about cleaning up it’s own institution. I don’t know if they are lazy, sanctimonious, unaware or unimaginative. Maybe they feel “It’s not my job”. They could at least come up with recommendations on how to approach this national problem. Our country can’t last long the way it’s going.

I believe the professor’s side of events as I have been skeptical of many of the women alleging these crimes. I don’t believe they should be automatically believed because they are women. Women lie, too. This is a typical reaction of going too far one way in trying to rectify things that happened in the past. The same types of people attempted to smear Judge Kavenaugh. I found this biographical treatise a very challenging view of man's (or woman's) viciousness to man. I wouldn't like to have such a trial but I do know similar exercises in animosity, toward another do happen in the workplace or in polite society. Usually it does not require a payment as such; most times it is not recognized by the target. Frequently, it isn't even recognized by the victim until much later, even years.


I'll say no more. Professor Dershowich is a great storyteller and as such must be a fine teacher. Witness his performance at the so-called impeachment.

His contention that he was not in the places where she said that he was at the times that she said that he was there is backed by evidence. What is less convincing is his contention that she is deliberately lying. One can be mistaken on dates and locations and even mistaken on which one of Epstein's acquaintances did something and still not be deliberately lying. For a different perspective on his accuser, Bradley Edwards has written an interesting book on the Epstein matter.

It is almost impossible to prove a negative: "I didn't do it." Alan Dershowitz manages to prove he couldn't possibly be guilty of the accusations against him. Somebody should charge these women who make outlandish accusations against people like Dershowitz and Kavanaugh, causing them immense expense, pain and embarrassment. There should be accountability.
