이승만의 박사논문: “미국의 영향을 받은 중립”President Syng Man Rhee’s Doctoral Dissertation: “Neutrality as Influenced by the United States”

초대 대통령 이승만은 1910년 미국 프린스턴 대학에서 「미국의 영향을 받은 중립(Neutrality as Influenced by the United States)」이란 제목으로 박사학위를 받았다. 그는 한국인 최초의 서양대학 박사학위 취득자이다. 20세기 초반 제국주의가 한창 발호하던 시절 그는 국제법에 어떠한 기대를 갖고 있었기에 국제법상 전시중립을 그의 박사학위논문 주제로 선택했을까? 그의 논문 내용은 무엇이었나? 그의 논문에 대한 학술적 평가는 어떻게 해야 할까? 이러한 질문들에 대한 답의 모색이 이 글의 목적이다.
도미 유학 전 이승만이 남긴 글을 보면 그는 국제법에 대해 장밋빛 기대를 갖고 있었다.
그는 만국공법을 지키는 가운데 문호개방을 통한 중립외교를 펼치는 방안이 조선의 독립을 유지하는 최선의 방안이라고 생각했다.
국제법 지식을 국내에 널리 보급하는 일이 시급하다고 주장했다. 이러한 그의 인식이 미국 유학 시 박사논문 주제 결정에 영향을 미쳤으리라 생각된다.
그의 논문은 중립법의 발전을 미국의 시각에서 정리하고 있다.
19세기까지 중요 전쟁은 유럽대륙에서 주로 발생했다. 대서양 건너의 미국은 중립을 유지하며 양 교전국과 모두 교역을 지속해 경제제적 이익을 도모하려 했다.
이러한 이유로 미국은 19세기 말까지 중립교역의 자유를 가장 열렬히 주장했으며, 중립법 발전에 가장 큰 영향을 미친 국가가 되었다.
그의 논문은 이러한 미국의 역할을 연대기 순으로 정리하고 있다. 다만 이 책자가 학술적으로 뛰어난 성취였다고는 평가하기 어렵다. 분석적이라기보다는 서술적인 내용이 대부분이다. 짧은 미국 수학생활에도 불구하고 그에게 깊이 있는 법학적 분석을 기대하기는 어려웠을 것이다.
Mr. Syng Man Rhee, the First President of the R.O.K., received Ph.D. at Princeton University, U.S. in 1910 at his age of thirty-five. The title of his dissertation was “Neutrality as Influenced by the United States.” He was the first Korean Ph.D. recipient at western universities. Why did he choose the neutrality law as his dissertation topic at the era of climax of the imperialism as well as the law of jungle in international society? What kind of expectation did he have for international law? President Rhee had rosy expectation regarding international law according to his articles and books before going to study at the U.S. universities. He thought that the best way to preserve Chosun’s independence should be to engage in neutral diplomacy through abiding by international law and opening door. So he insisted to disseminate the knowledge of international law in Chosun immediately. This kind of his perception might influence the choosing the topic of his dissertation later. During 18th or 19th period major wars broke out between European states. The U.S. as a neutral, tried to pursue her economic interest through continuing her trade with both European belligerents. So the U.S. had been the most active advocate for neutrality law. His dissertation explained the development of the law of neutrality until mid-19th century from the U.S. perspective. However, it is difficult to say his dissertation showed a high level of academic achievement, because the most of its contents was descriptive explanation about the history of neutrality law and did not show in-depth analysis from legal point of view.
